Divorce and Asset Distribution

Divorce proceedings typically involve filing a divorce action, dividing property, and making arrangements with respect to any children that the former spouses had together.  With respect to division of property, New York uses an "equitable distribution" system, which dictates that marital property is divided equitably - not necessarily equally - and according to each spouse's contribution to the marriage.  At Coffinas & Lusthaus, we have considerable expertise in divorce and asset distribution, including asset restraint, asset finding, and complex division of assets, such as 401(k) retirement plans.  Our attorneys can guide you through the process and advocate for your best interests in negotiations and in court.

Child Custody, Child Support, Visitation, and Relocation

The experienced family law attorneys at Coffinas & Lusthaus assist clients in all aspects of child custody and support matters, including visitation and relocation.  These issues must be resolved initially at divorce but they may also be revisited later, as families' circumstances often change over time, requiring a new arrangement or adjusted court order. 

In New York, the amount of child support that will be ordered is based upon a statutory formula.  Child custody arrangements may be made by the divorcing spouses; where the spouses are unable to reach an agreement, the court will step in.  The court's custody determinations generally revolve around what it believes is in the child's best interests, taking into account numerous factors.  At Coffinas & Lusthaus, we have substantial experience helping clients negotiate a satisfactory custody and financial support arrangement.  In appropriate cases, our lawyers can also assist with visitation orders as well as requests for relocation, where a custodial parent wishes to move away.

Real Estate Closings and Simple Wills and Trusts

At Coffinas & Lusthaus, our practice focuses primarily on marital and family law.  However, we understand that in the process of divorce, issues related to estate planning and real property regularly arise.  For example, a client may need to buy or sell a house, or they may wish to update their will, name a guardian, or create a trust for their children.  Consequently, as a courtesy to our family law clients, we also handle real estate closings and simple wills and trusts.
